Contact: info@bavicon.eu

on this website.

The legal basis of data protection can be found in the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG), as well as in the new data protection guidelines ( DSGVO – valid from May 25, 2018 ) and the BGH ruling from May 28, 2020.

Data collection

Basically, a distinction must be made between data that is voluntarily transmitted by a person to us via email or contact form …… and data that is collected more automatically by using the website.

Automatically collected data includes e.g. records (server logs) of the provider as well as cookies or data tracking of additional modules integrated into the website, which are useful for better usability or graphical improvement, but are also used by some manufacturers to record information that serves the marketing-oriented evaluation – e.g. to get to know the surfing behavior of a user.

This principle is helpful to better understand the following paragraphs.

What is personal data according to data protection

Personal data is information that can be used to identify a person, i.e. information that can be traced back to a person. This includes the name, address, place of residence, e-mail address, telephone number as well as actions that can be assigned to a person, as well as data about preferences, hobbies, memberships or which websites were viewed by someone, count as personal data.

Handling personal data

We take data protection faithful to our laws very carefully. Personal data that you send us digitally or in any other way (as described above is your name including address, your request, etc.). ) will be used by us very confidentially and will not be given to third parties, unless the legal situation so requires or it is legally legitimate and the user agrees to it.

When contacting us (for example, by e-mail), the information provided by the user will be stored for the purpose of processing the request and in the event that follow-up questions arise. Furthermore, this data is stored securely by us.

In certain cases, however, it may be that a forwarding of personal data can not be excluded. As already noted above, if extensions are provided in a website, which on our part should give more to the comfort and the function suggestion, but on the other hand from enterprises as for example from Google at the same time with to it are used to record data for marketing purposes ( Trackings ). However, it is not assumed that this is intended to cause you any deliberate harm. However, we cannot assume any responsibility for such recordings.

Please also note that data is generally not always transmitted securely on the Internet. Especially in e-mail traffic, protection during data exchange cannot be guaranteed.

If you contact us via our contact form, your data is protected by SSL encryption ( https:// ) in the best sense of the technical possibilities and is therefore better suited to protect your data than pure e-mail traffic.

You can obtain information free of charge at any time about the personal data we have stored about you and about the origin, recipient and purpose of data collection and data processing. You also have the right to request the correction, blocking or deletion of your data.

This does not apply to data that is retained on the basis of statutory regulations or is required for proper business processing. To ensure that a data block can be implemented at any time, data is kept in a blocking file for control purposes. If data is not covered by a legal archiving obligation, we will delete your data at your request. If the archiving obligation applies, we will block your data. For all questions and concerns regarding the correction, blocking or deletion of personal data, please contact us at the address given in the imprint.

Data subject rights are regulated accordingly in the GDPR provisions.

Data collected via third-party tracking is not addressed here. This is also beyond our legal reach.

Autoactive components

Cookies and Javascript are used for our information offer. These components can be deactivated in the browser software, thus making data recording in the background very difficult, but also under certain circumstances the functionality of the website no longer appears as given.

Access data/ Server log files

The provider (or its web space provider) collects data about each access to the offer (so-called server log files). The access data includes:

Name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider.

The provider uses the log data only for statistical analysis for the purpose of operation, security and optimization of the offer. However, the provider reserves the right to check the log data retrospectively if there is a justified suspicion of unlawful use based on concrete indications.

Cookies

Cookies are small files that allow to store on the user’s access device (PC, smartphone or similar) specific information related to the device. On the one hand, they serve the user-friendliness of websites (e.g. storage of login data) and the functionality of the websites. On the other hand, these serve to collect statistical data on website usage and to be able to analyze it for the purpose of improving the offer (e.g. via Google Analytics ). In addition, cookies may be used for marketing-related reasons by individual companies whose products are integrated interactively on the websites to record the user behavior of visitors in order to collect marketing-oriented user profiles.

Google Extensions

We would like to point out once again that when using Google Maps, a data collection with information about your surfing behavior and your IP address are transmitted to the respective servers in the USA. How they are evaluated there is not entirely clear to the outside world, and how they are processed there in a personal context can be clarified directly with their company.

Google Web Fonts

We do not embed any fonts (“Google Fonts”) from the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Our project uses only system fonts.

General Plugins, Add-ons, Extentions

Our website was created with a modern CMS system. Modern CMS systems offer the possibility of extending the scope of functions of a website through additional installations. This is done as a result of a better usability as well as an improvement of the graphical representation. Sometimes, such plugins of various manufacturers, as already mentioned in the privacy policy, are additionally supplemented by data tracking.

Our website has a minimum of other plugins ( JQUERY … ), whose functionalities do not have any data tracking after a precise check and can therefore be considered compliant with data protection. We have done our analysis conscientiously, but refrain from disposing of this in a legally binding manner.

JQUERY is integrated as a standard module in many websites and represents a basic technical necessary facility for many functionalities ( DSGVO Art. 6, para. 1 letter f ). JQUERY as well as many other extensions do not set cookies.

Warranty

We have made a lot of effort to take into account the new data protection guidelines ( DSGVO ), as well as the BGH ruling v. 28.05.2020 for Germany to give consideration. However, if anyone takes offense to our privacy policy, we ask that you contact us at the details in the imprint to seek a solution by mutual consent.

First of all, we would like to point out that there are many details in the new privacy policy that do not yet appear to have been definitively clarified from a legal point of view.

Google Analytics with opt-out

We use the Google Analytics tool to record data. If you do not want these recordings for our marketing purposes, you are free to prevent the data recording via the opt-out offered below or to release them afterwards. We would appreciate it if you would allow us to record the data. We only use this data for our own purposes, it is safe with us and will not be passed on to third parties. Furthermore, the data is collected ip-anonymously, a direct conclusion to your person is therefore not possible and is not in our interest anyway.

Under the following link you can also download and install the available browser plugin, for example, to create an opt-out for Google Analytics in the browser. https://tools.google.com/dlpage/gaoptout?hl=de – however, this is not necessary due to the opt-out offered here.
